Standard Probation

The Probation Division is responsible for supervising defendants during both pre and post adjudication. Standard supervision consists of a Pre-Sentence Investigations Unit, Misdemeanor Pretrial Supervision Unit, Felony Pretrial Unit, Standard Probation Unit, and the DWI First Offender Unit. In addition, the Probation Division’s In-House Screening Unit administers screenings as state statute requires for DWI cases. The required screening is the Impaired Driving Assessment (IDA). This assessment, in conjunction with the RANT, provides a risk level for each client. This risk level is then used by the supervising probation officer to assist in developing a comprehensive supervision plan.

Pre-Sentence Report/Intake Unit

The Pre-Sentence Unit is responsible for completing all non-specialty court pre-sentence reports. The pre-sentence reports cover all case types and consist of client demographic information, social history, criminal history, and sentencing recommendation. This unit also completes reports for the purposes of investigating restitution amounts for victims of crimes adjudicated through the Metropolitan Court. 

Standard Supervision Unit

The Standard Probation Unit supervises cases consisting of misdemeanor probation cases, cases pled from felony charges, in-custody cases, and cases that are in warrant status. Most standard supervision clients either chose not to participate in a specialty court or were not eligible for participation in a specialty court.

DWI First Offender Program

The DWI First Offender Program supervises all defendants found guilty of a DWI First Offense.  This unit also monitors compliance with all statutory requirements for a DWI first offense. This supervision includes monitoring attendance of the DWI School, the Mothers Against Drunk Driving Victim Impact Panel, and community service. Additionally, the unit monitors all pending DWI cases for defendants who have been ordered to have an ignition interlock but not ordered to pretrial supervision. This unit consists of six probation officers, a program project specialist, a leadworker, and a supervisor. The entire First Offender Staff works closely with the In-House Screening unit to establish proper treatment referrals and supervision plans for the First Offender population. Two of the six probation officers in this unit and a surveillance officer leadworker are funded through a grant from the New Mexico Department of Transportation – Traffic Safety Bureau. This grant also provides funding for enhanced alcohol laboratory testing for defendants ordered to participate in the DWI First Offender Program. All treatment assessments and recommended counseling for First Offender clients is paid through a grant from Bernalillo County.  The DWI First Offender Program is the most active unit in the Probation Division with close to one thousand current participants.   

Misdemeanor Pretrial Unit

Five pretrial officers work in the Misdemeanor Pretrial Supervision Unit and provide pretrial supervision to misdemeanor clients at Metropolitan Court. Similar to the Pre-Sentence Unit and the Standard Supervision unit, the misdemeanor pretrial unit monitors all case types until the case is adjudicated.  

Felony Pretrial Unit

On October 1, 2017, the Metropolitan Court Probation Division began supervising all Felony Pretrial defendants referred from Metropolitan Court felony arraignments. Prior to October 1, 2017, these defendants were referred to the Second Judicial District Court Pretrial Services. This includes the monitoring of actively reporting defendants, monitoring in-custody cases, and actively working with law enforcement in locating defendants with warrants. Defendants ordered to participate with GPS systems are monitored 7 days a week, 24 hours a day. Funding for GPS and three probation officers in this unit is provided by Bernalillo County.

Clerical Staff

The clerical staff assist in numerous aspects within the Probation Department including, but not limited to maintaining the Noble database, assigning cases, processing restitution payments, requesting police reports and MVD history, notarizing documents, and retrieving and distributing mail for the division. This unit consists of a supervisor, two leadworkers, and ten judicial specialists. Two of the judicial specialist positions are provided by Bernalillo County.
