Applications for Free Process – Rule 4-222 NMRA
For Attorneys: To request free process on behalf of a client using the electronic filing system File & Serve, submit the following document using your waiver account:
** Wage Claims – There is no filing fee for wage claims brought under NMSA 1978, § 50-4-26(E), and the attorney would select “waiver” as the “payment account” option in File and Serve.
For Self-Represented Litigants: Applications for Free Process must be notarized. You may submit your Application for Free Process in person at the court, where a Customer Service employee may notarize your document free of charge, you may mail in your completed Application for Free Process with a copy of your proposed Civil Complaint, or you may email your Application for Free Process with your proposed Civil Complaint to metrocivilpleadings@nmcourts.gov. The Court will notify the self-represented litigant via telephone call if the application for free process has been approved.
**Wage Claims – There is no filing fee for wage claims brought under NMSA 1978, § 50-4-26(E), there is a box to check on the Application for Free Process if you are a Self-Represented Litigant filing a Civil Complaint for wage claims.
