Applications for Free Process – Rule 4-222 NMRA

For Attorneys: To submit an Application for Free Process and proposed Order for Free Process to the Metropolitan Court using the electronic filing system File & Serve, submit the following documents using your waiver account:

  1. Application for free process using filing code: free process
  2. Order on application for free process using filing code: proposed order

 If the Application for Free Process has been approved, when the attorney starts a new case in File and Serve, the attorney should include the approval of the free process that the attorney has received from the Court and should select “waiver” as the “payment account” option.

** Wage Claims – There is no filing fee for wage claims brought under NMSA 1978, § 50-4-26(E), and the attorney would select “waiver” as the “payment account” option in File and Serve.

 For Self-Represented Litigants: Applications for Free Process must be notarized. You may submit your Application for Free Process in person at the court, where a Customer Service employee may notarize your document free of charge, you may mail in your completed Application for Free Process with a copy of your proposed Civil Complaint, or you may email your Application for Free Process with your proposed Civil Complaint to metrpleadings@nmcourts.gov. The Court will notify the self-represented litigant via telephone call if the application for free process has been approved.

 **Wage Claims – There is no filing fee for wage claims brought under NMSA 1978, § 50-4-26(E), there is a box to check on the Application for Free Process if you are a Self-Represented Litigant filing a Civil Complaint for wage claims.
